Contempt Actions - Child Support
Are you owed child support? Is your former spouse behind in alimony payments? Is the mother of your children denying you your court ordered visits with your children? A Contempt Action is used to enforce clear, unequivocal court orders which are wilfully disregarded and not being obeyed. A Contempt Action is the means by which we help you force the other party to comply with the court order. Examples are: temporary orders in a family law matter; judgments in family law matters; and temporary, preliminary or permanent injunctions.
If its orders are not being followed, the court has all the tools available to it to force compliance as in any other type of case. The court can change custody or visitation arrangements, or it could order counseling for one or both of the parties. Where someone is deliberately not paying something the court ordered be paid, such as child support, enforcement tools include incarceration.
If the other party is found to be in contempt, that party will probably also be ordered to pay part or all of your attorney's fees and expenses.
