If you've been hurt in a car accident, you have certain rights, even if you're at fault. These are called "Personal Injury Protection" ("PIP" for short) benefits. These benefits, in Massachusetts, pay the first $2,000 in medical expenses (and maybe more), as well as a portion of lost wages.

You may have more legal rights, namely the right to make a claim against the other driver or drivers who are at fault for the accident. You may even be able to make a claim if you're partly at fault, so long as your fault is not more than 50%. Depending on what coverage you have for your automobile policy, you may even be able to recover for your damages from your insurance for an accident that is the other driver's fault. Perhaps even if the other driver does not have insurance.

You should understand that there is a time limit (a statute of limitations) to file a claim in court against the other driver or drivers who are at fault. In Massachusetts, that time limit is three years; in other states, it is two years, or even less. Claims against your own insurance company must be filed within six years.
