Annulments
An annulment does more than terminate a marriage. An annulment establishes that the legal marital status never existed in the first place. This is exactly the difference between a divorce and an annulment. A divorce raises many issues, from alimony to division of property. If the marriage never existed, none of these issues arises.
Not all marriages qualify for an annulment. In Massachusetts, annulment is appropriate for voidable marriages. Examples of voidable marriages are: underage spouse(s); a close blood relationship between the parties (such as brother-sister), a spouse who is insane at the time of marriage; a spouse who is impotent at the time of marriage and a marriage where one spouse induces the other to enter the marriage by perpetuating a fraud that goes to the essence of marriage.
